1. Company Information
THECAVIARHOUSE is legally incorporated in Mykonos, Greece.
Product preparation, packaging, and dispatch for online orders take place from our ISO 22000‑certified packaging unit facilities in Vari, Athens, Greece.
2. Acceptance of Terms
By accessing or ordering from our website, you acknowledge that you have read, understood, and agreed to these Terms & Conditions and all policies referenced herein.
3. Orders

All orders placed through www.thecaviarhouse.com (“Website”) are subject to acceptance and availability.

Receipt of an order confirmation email does not constitute acceptance until payment has been successfully processed.

The User must provide accurate and complete delivery information. THECAVIARHOUSE is not responsible for failed delivery due to inaccurate or incomplete information provided by the User.
4. Shipping & Delivery

Shipping terms, charges, delivery regions, cut‑off times, and customer obligations are described in our Shipping Policy

The User is responsible for monitoring tracking information and ensuring availability for delivery.

THECAVIARHOUSE is not liable for delivery delays resulting from third‑party couriers or User unavailability.
5. Pricing & Payment

All prices are in EURO (€) and include VAT, except where otherwise specified.

Payment must be completed at the time of order via the available secure payment methods.

THECAVIARHOUSE reserves the right to correct pricing errors at any time prior to dispatch.
6. Refunds & Returns
Refunds and returns are governed by the nature of the products and applicable law. Due to the perishable nature of our products, refunds or returns are only accepted for products with confirmed defects or non‑conformity under Greek consumer protection law, and only when reported promptly in accordance with our Refund Policy.
7. Liability for Defects

In accordance with Greek Law (Law 2251/1994) and Article 534 of the Greek Civil Code, THECAVIARHOUSE is liable for actual defects or lack of agreed conformity that exist at the time the products are delivered to the User.

THECAVIARHOUSE is not liable for deterioration, spoilage, or quality issues that arise after delivery, including but not limited to cases caused by:

Delays or mishandling by third‑party couriers

Failed delivery attempts due to User unavailability

Improper storage or handling after receipt

The User must inspect products immediately upon delivery and report any issues without delay according to the procedures in the Refund Policy.
8. Food Safety & Compliance

All products are prepared, handled, packaged, and dispatched in compliance with applicable European Union and Greek food safety legislation.

Our processes are managed under a certified ISO 22000 Food Safety Management System, ensuring strict hygiene, temperature control, traceability, and product integrity throughout preparation and dispatch.

9. Intellectual Property
All content, images, designs, trademarks, and product descriptions on the Website are the property of THECAVIARHOUSE or its licensors and are protected by international intellectual property laws. Unauthorized use is prohibited.
10. Privacy and Data Protection
Personal data is collected and processed in accordance with our Privacy Policy.
11. Right of Withdrawal – Excluded
In accordance with Article 16(c) of Directive 2011/83/EU and Greek Law 2251/1994, the standard 14‑day right of withdrawal does not apply to perishable goods liable to deteriorate or expire rapidly, or goods that are not suitable for return for health or hygiene reasons once delivered. Therefore, once an order has been dispatched from our facilities, it cannot be cancelled, returned, or refunded, except where required by law for defective or non‑conforming products.
12. Order Change & Cancellation
12.1 An order may be changed or cancelled only if it has not yet been dispatched from our facilities.
12.2 Once an order has been dispatched, it is finalized and cannot be cancelled, modified, or returned, due to the perishable nature of the products.
12.3 After order confirmation, the delivery address cannot be changed for security and anti‑fraud reasons.
12.4 If a cancellation is accepted prior to dispatch, the refund will be made using the original payment method or another agreed method. Third‑party processing or transaction fees may apply and are borne by the User.
13. Customer Responsibility

Users must be available to receive their deliveries or arrange for secured pickup.

Customers are responsible for ensuring proper product storage immediately upon delivery as described in the Shipping Policy and product emails.
14. Force Majeure
THECAVIARHOUSE is not liable for delays or non‑performance caused by events beyond its control, including acts of god, pandemics, strikes, war, government actions, epidemics, courier disruptions, or other unforeseeable events.
15. Dispute Resolution – EU ODR
For EU residents, you have access to out‑of‑court online dispute resolution (ODR).

16. Governing Law & Jurisdiction
These Terms & Conditions are governed by Greek law.
Any dispute arising out of or related to these Terms shall be resolved exclusively by the courts of Piraeus, Greece.
17. Changes to These Terms
We reserve the right to modify these Terms at any time. All changes will be posted on the Website with an updated effective date. Your continued use of the Website constitutes acceptance of the updated Terms.
18. Entire Agreement
These Terms & Conditions and the policies referenced herein constitute the entire agreement between you and THECAVIARHOUSE concerning the subject matter.
